THIS IS A CONTRACT. BY OPENING ANY ALFREDOM PACKAGE YOU ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. You may return this media envelope, UNOPENED and along with the rest of the package, within 15 days if you do not agree with the terms and conditions of this Agreement, for a full refund of all money you paid for the product. If you purchased this product through a store or second party distributor, you must seek your refund through the original seller. Return the entire package with your purchase receipt (or photocopy of your purchase receipt). If purchased directly from AlfredoM (aka Alfredo Malchiodi), seek return authorization and instructions contacting us at alfmal@tsoft.net. Downloadable images are not refundable.
LICENSE AGREEMENT
United States copyright law and international trade provisions protect these art &/or photographic images (hence forward to be referred to simply as “images”) created by AlfredoM. Nevertheless, AlfredoM recognizes that you have licensed this copy of the images so that you may copy them in their present form, possibly modify them, and incorporate them into another work.

AlfredoM, therefore, grants you permission to copy and modify these images for your own internal use. You may use the contents as decorative, typographic, or illustrative material that is included as part of a total graphic design for print or other communication channels produced for yourself, your client, or for your employer, provided that it is not for resale or redistribution as art for reproduction or as any form of stock design.
AlfredoM, also, grants you provisional permission to incorporate and distribute duplicated or modified images as an incidental part of any non-electronic product or collection of products which are distributed commercially (i.e., distributed for profit, such as a newsletter, brochure, packaging, etc.), provided the use or distribution of any of the images does not constitute a substantial portion of the value of the goods distributed commercially. For example, you may not use an image as an art image on a poster manufactured for resale or on an item of clothing manufactured for sale without permission from AlfredoM.
The image content, in whole or in part, may not be used for multiple resale in the form of stock proofs, engravings, film, mats, printing, digitized images, etc., without written permission. The images may not be distributed as part of any software product, nor as part of an electronic document or collection of documents, without written permission from AlfredoM.

There is no transfer of ownership rights to contents, in whole or in part, to you with the purchase or use of this software or the images. You may make one (1) backup copy of the software only. You may not copy the software, its contents or catalogs to sell or distribute to others.

AlfredoM grants you this license for a maximum of 3 CPUs (central processing unit) owned by one person or business entity only.
AlfredoM software and/or images may not be distributed for use through a Local Area Network (LAN), or Wide Area Network (WAN) unless a license has been purchased covering each CPU on the network.

Warranty

LIMITED WARRANTY
The software by AlfredoM is warranted, for ninety (90) days from the date of the original purchase of this product, against defects in material and workmanship (assuming normal use). The images, also, are warranted to conform with the visual index/manual for ninety (90) days from original purchase. In the instance of a defective disk, the defect disk shall be replaced at no charge to you provided you return the disk to AlfredoM (at the address provided below) with a photocopy of the receipt within 90 days of purchase date. Refund of the purchase price or replacement of the disk is your sole and exclusive remedy, as well as AlfredoM’s sole and exclusive liability in accordance with this limited warranty. Downloadable images are not refundable.

THE ABOVE WARRANTY IS THE ONLY WARRANTY OR REPRESENTATION OF ANY KIND WITH RESPECT TO THE IMAGES MADE BY ALFREDOM, OR ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, DELIVERY OR LICENSING OF THESE IMAGES. The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, express or implied. No person employed by AlfredoM or acting as dealer, or agent is authorized to make any modification, extension, or addition to this warranty.

Though you may have other rights that vary from state to state, this warranty gives you specific legal rights.

DISCLAIMER OF DAMAGES
In no event will AlfredoM or his suppliers or distributors be liable for direct, indirect, special, consequential, or incidental damages resulting from the use of the images, or any defect in the images, or manual, even if they have been advised of the possibility of such damages. In particular, AlfredoM and /or his suppliers and/or distributors shall have no liability for any programs or data used with AlfredoM’s software products, including the cost of recovering or reproducing these programs or data.
